The matter
The best disputes are the ones the contract already anticipated.
Cross-border disputes are decided long before anyone files: in the dispute clause, the governing law, the seat, and in whether an award or judgment can actually be enforced where the assets are. When a conflict arrives, the question is not only who is right, but where and how that can be made to count.
Joaquín presides over the ICC Bajío Arbitration Committee and is a registered arbitrator with the ICC, CAM, CANACO and IBT Panama. He advises clients on drafting dispute clauses, on institutional arbitration and on the litigation that surrounds it in Mexico, working alongside Texas counsel when a matter touches both systems.
